I have recently came across a trademark which is very similar to my own. I found that such trademark is already registered before the Trademark Office, but my trademark was registered previously. What actions can I take?
When a trademark registration is granted by an error from the Trademark Office, a nullity action can be brought against it. If the latter trademark is considered similar to the extent of confusion and is applied to same or similar products, the nullity of the latter trademark should proceed.
